1. Agreement to Terms

By accessing or using UseLiveSocial ("the Service," "we," "us," or "our"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms apply to all visitors, users, and others who access or use the Service.

UseLiveSocial is operated by an individual sole proprietor based in the United States. By using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you are using the Service on behalf of a company or organization, you represent that you have authority to bind that entity to these Terms.

2. Description of Service

UseLiveSocial is a creator intelligence platform that provides the following services:

  • Creator Tracking — Monitor publicly available data from TikTok, YouTube, Twitch, Kick, and other platforms including follower counts, views, engagement, and live stream status.
  • Creator Intelligence Report — AI-powered scoring and analysis of creator profiles using our proprietary Creator Power Index (CPI).
  • Trend Intelligence — Real-time and historical trending content data across platforms.
  • Creator Marketplace — A platform connecting brands with creators for sponsorship and collaboration opportunities.
  • Brand-Creator Introductions — A facilitated introduction service where UseLiveSocial acts as an intermediary between brands and creators, subject to a platform fee on closed deals.

We do not collect, store, or process any private data from social media platforms. All creator data displayed is publicly available and sourced from official platform APIs or public endpoints. The Service is provided for informational and business research purposes only.

3. Eligibility

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you are at least 18 years old, have the legal capacity to enter into these Terms, and are not prohibited from using the Service under any applicable laws. If you are under 18, you may not use the Service under any circumstances.

The Service is intended for use by businesses and professionals in the creator economy. By using the Service, you represent that your use is for lawful business or professional purposes.

4. User Accounts

When you create an account with us, you must provide accurate, complete, and current information. You are solely responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account, whether or not authorized by you.

You agree to immediately notify us at admin@uselivesocial.com of any unauthorized use of your account or any other security breach. We will not be liable for any loss or damage arising from your failure to protect your account credentials. We reserve the right to terminate accounts, refuse service, or remove content at our sole discretion, with or without notice, for any reason including violation of these Terms.

5. Subscription Plans & Payment

UseLiveSocial offers the following subscription tiers: Free, Creator ($9/month), Pro ($49/month), and Agency ($149/month). Paid plans are billed on a recurring basis (monthly or annually) through our payment processor, Stripe. By subscribing to a paid plan, you authorize us to charge your payment method on a recurring basis until you cancel.

All fees are non-refundable except as required by applicable law. If you cancel a paid plan, you will retain access until the end of your current billing period, after which your account will revert to the Free plan. We reserve the right to modify pricing at any time with at least 14 days' notice to existing subscribers. Continued use after a price change constitutes acceptance of the new pricing.

Free trials, where offered, are provided at our sole discretion. We reserve the right to limit one free trial per person or organization. Abuse of the trial system may result in account termination.

If a payment fails, we may suspend your access to paid features until payment is resolved. We are not responsible for any service interruptions resulting from payment failures.

6. Creator Marketplace & Introduction Service

The UseLiveSocial Marketplace allows Agency plan subscribers to browse creator profiles and submit brand deal inquiries. By submitting a Request Introduction form or using the Marketplace in any way, you acknowledge and agree to the following:

  • UseLiveSocial acts as an intermediary only and does not guarantee any deal will be closed or that any introduction will result in a business relationship.
  • A 10% platform fee applies to the total deal value of any sponsorship, collaboration, or brand deal that is initiated through the UseLiveSocial Marketplace and subsequently closed, regardless of where the final agreement is executed.
  • You agree to disclose to UseLiveSocial any deal that originates from a Marketplace introduction within 7 days of closing, regardless of whether the final agreement is executed on or off the platform. Failure to disclose constitutes a material breach of these Terms.
  • Creator profiles on the Marketplace are populated from publicly available data. UseLiveSocial does not guarantee the accuracy of creator profiles, follower counts, engagement statistics, or claimed rates.
  • Creators must complete a verified claim process before their profile is considered official. Unclaimed profiles are informational only and do not represent a direct relationship with the creator.
  • UseLiveSocial is not a party to any deal, contract, or agreement made between brands and creators. Any disputes between brands and creators are solely between those parties.
  • UseLiveSocial reserves the right to remove any creator or brand from the Marketplace at its sole discretion, with or without notice.

7. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable local, state, national, or international law or regulation
  • Harass, stalk, threaten, defame, or harm any individual, creator, or organization
  • Scrape, copy, reproduce, or redistribute data from the Service without our express written permission
  • Attempt to gain unauthorized access to any portion of the Service, its infrastructure, or related systems
  • Use automated scripts, bots, crawlers, or tools to access the Service without prior written consent
  • Transmit any viruses, malware, ransomware, or other malicious or harmful code
  • Impersonate any person, creator, brand, or entity, or misrepresent your affiliation with any person or entity
  • Use the Service to conduct competitor intelligence gathering for the purpose of building a competing product
  • Use the Service for any fraudulent, deceptive, or misleading purpose
  • Attempt to reverse-engineer, decompile, or extract the source code or proprietary algorithms of the Service
  • Use the Service for any commercial purpose not expressly permitted by these Terms

Violation of this section may result in immediate account termination and, where appropriate, referral to law enforcement.

8. Intellectual Property

The Service and its original content, features, functionality, design, algorithms, scoring systems (including the Creator Power Index), and all underlying technology are and will remain the exclusive property of UseLiveSocial and its owner. The Service is protected by copyright, trademark, trade secret, and other applicable intellectual property laws.

Our name, logo, and trademarks may not be used in connection with any product or service without our prior written consent. You may not use our branding in any way that implies endorsement or affiliation without authorization.

Creator names, channel names, platform usernames, and social media content referenced in the Service remain the property of their respective owners. We do not claim ownership of any third-party content displayed through the Service. If you believe your intellectual property rights have been violated, please contact us at admin@uselivesocial.com.

9. Third-Party Data & APIs

The Service relies on third-party APIs including the YouTube Data API, TikTok API, Twitch API, and Kick API. We are not responsible for the accuracy, availability, completeness, or legality of data provided by these third parties. Data may be delayed, inaccurate, cached, or unavailable at any time without notice.

Your use of the Service is also governed by the terms of service of the respective social media platforms whose data we display. We are not affiliated with, endorsed by, sponsored by, or officially connected to YouTube, TikTok, Twitch, Kick, or any other platform. All product names, logos, and brands are property of their respective owners.

We reserve the right to discontinue support for any third-party platform at any time without notice or liability.

10. No Guarantee of Results — AI & Analytics Disclaimer

The Creator Power Index (CPI), Intelligence Briefs, budget allocation recommendations, engagement scores, trend data, and all other analytics, scores, or reports generated by UseLiveSocial are provided for informational and research purposes only. They do not constitute financial, marketing, legal, investment, or business advice of any kind.

UseLiveSocial makes no guarantee, representation, or warranty that:

  • Any creator recommendation will result in a successful brand deal, campaign outcome, or return on investment
  • CPI scores or engagement metrics accurately predict future performance or audience behavior
  • Creator data displayed is current, accurate, or complete at the time of viewing
  • Marketplace introductions will result in closed deals or any positive business outcome
  • AI-generated insights, briefs, or verdicts are free from error, bias, or omission
  • Trend data reflects real-time conditions on any platform

All decisions made based on information provided by the Service — including but not limited to sponsorship investments, campaign budgets, creator partnerships, hiring decisions, and business strategies — are made entirely at the user's own risk. UseLiveSocial shall not be liable for any losses, damages, or outcomes arising from reliance on our analytics, scores, or recommendations.

The creator economy is dynamic and unpredictable. Past performance, engagement rates, and follower counts do not guarantee future results. Users are strongly encouraged to conduct their own independent due diligence before making any business or financial decisions.

11. Privacy & Data Protection

Your use of the Service is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection, use, and processing of your information as described in our Privacy Policy.

California Residents (CCPA)

If you are a California resident, you have specific rights under the California Consumer Privacy Act (CCPA), including the right to know what personal information we collect, the right to request deletion of your personal information, and the right to opt out of the sale of your personal information. European Users (GDPR)

If you are located in the European Economic Area (EEA), United Kingdom, or Switzerland, you have rights under the General Data Protection Regulation (GDPR) or equivalent applicable law, including the right to access, correct, or delete your personal data, the right to restrict or object to processing, and the right to data portability. Our legal basis for processing your data is your consent and our legitimate interest in providing the Service. To exercise your rights or lodge a complaint, contact us at admin@uselivesocial.com. You also have the right to lodge a complaint with your local data protection authority.

Data Retention

We retain your account data for as long as your account is active or as needed to provide services. Upon account deletion, we will delete or anonymize your personal data within 30 days, except where retention is required by law.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. WE MAKE NO WARRANTY THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS.

We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses, bugs, or other harmful components. We do not warrant the accuracy, completeness, reliability, or usefulness of any information provided through the Service. Any reliance on the Service is at your own risk.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL USELIVESOCIAL, ITS OWNER, OFFICERS, EMPLOYEES, AGENTS, PARTNERS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, DATA, GOODWILL, BUSINESS OPPORTUNITIES, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE.

IN NO EVENT SHALL OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100 USD).

THE LIMITATIONS IN THIS SECTION APPLY WHETHER THE LIABILITY ARISES UNDER CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF USELIVESOCIAL HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

14. Indemnification

You agree to defend, indemnify, and hold harmless UseLiveSocial and its owner, officers, employees, agents, partners, and licensors from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising out of or relating to: (a) your violation of these Terms; (b) your use or misuse of the Service; (c) your violation of any third-party rights, including intellectual property or privacy rights; (d) any content you submit or transmit through the Service; or (e) any dispute between you and a third party, including creators or brands you engage through the Marketplace.

15. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason at our sole discretion, including if you breach any provision of these Terms. Upon termination, your right to use the Service will immediately cease and any data associated with your account may be deleted.

You may cancel your account at any time by contacting us at admin@uselivesocial.com. Cancellation does not entitle you to a refund for any fees already paid. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

16. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Florida, without regard to conflict of law principles. You agree that any legal action or proceeding arising out of or related to these Terms or the Service shall be subject to the exclusive jurisdiction described below.

Arbitration: Any dispute, claim, or controversy arising out of or relating to these Terms or the Service — including questions of arbitrability — shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration shall be conducted in English. The arbitrator's award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

Class Action Waiver: YOU AND USELIVESOCIAL AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims.

Exceptions: Either party may seek injunctive or other equitable relief in a court of competent jurisdiction for violations of intellectual property rights or unauthorized access to the Service without waiving the right to arbitrate other claims.

Time Limit: Any claim arising under these Terms must be brought within one (1) year of the event giving rise to the claim, or it is permanently barred.

17. Changes to Terms

We reserve the right to modify these Terms at any time. For material changes, we will provide at least 14 days' notice by updating the "Last updated" date at the top of this page and, where appropriate, notifying you by email to the address associated with your account. For non-material changes, we may update the Terms without notice.

Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service and cancel your account.

18. General Provisions

Entire Agreement: These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and UseLiveSocial regarding your use of the Service and supersede all prior agreements.

Severability: If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

No Waiver: Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

Assignment: You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.

Force Majeure: We will not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including natural disasters, pandemic, war, government action, internet outages, or third-party platform failures.
